You also understand and agree that the Service may include advertisements and that these advertisements are necessary for RockeTalk to provide the Service. You also understand and agree that the Service may include certain communications from RockeTalk, such as service announcements, administrative messages and newsletters, and that these communications are considered part of RockeTalk membership and you will not be able to opt out of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new RockeTalk properties, shall be subject to the TOS. You understand and agree that the Service is provided "AS-IS" and that RockeTalk assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Service, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service. By using the Service, you also accept that we may copy, transmit and distribute your content including audio, voice, photos and videos to various partners you select and that we have no control over these partners' websites or services or the accounts they provide you. We are not responsible for any connection or access to the Service by you, or the quality of the transmission of any information that you submit via the Service; we do not guarantee that the Service will work on all mobile handsets, or that the Service will be compatible with all mobile networks or be available in all areas. We do not guarantee that the Service will be error free or free from interruption or other failures, or that the Service will satisfy your specific requirements. The Service may be unavailable because of maintenance, upgrades and emergency repairs, failure of telecommunications links and equipment, or other causes that are beyond our control. We will take reasonable steps to minimize disruption to the Service where it is within our reasonable control. We may modify or discontinue temporarily or permanently providing the Service or any of its features with or without notice. We cannot guarantee that the software will be free of all viruses. We have no obligation to provide maintenance services or technical support for the Service. |
